PROBATE
Probate is the legal
proceeding by which an estate is passed to the heirs when a Will has
been used to bequeath property. Often, there is a legal proceeding
in probate court in California.
Probate can be a
complex and lengthy legal proceeding, and particular attention needs
to be paid to minimizing the loss of the deceased’s property through
the probate process.
Probate fees are
generally set by law, and regulated by the Probate Court. This means
that any attorney is paid essentially the same fee for the work done
in a probate matter.
Bob Ehrle has
extensive experience in probate matters, and has represented clients
and estates from relatively small and straightforward cases, to
complex will contest litigation involving commercial property.
If a probate needs to
be opened, contact Allen & Ehrle for an analysis and estimate of
probate costs and fees.
As with any legal
proceeding, it is very important for the client to understand the
proceeding, have it explained to them in straightforward language,
and know what to expect. This is precisely what Bob Ehrle does in
all his probate cases, and will do in yours.
TRUST ADMINISTRATION
Over the past decade
many individuals have opted for trusts as an alternative to Wills.
Trusts have several advantages to Wills, notably the lack of probate
and probate fees, but present some special legal issues.
Bob Ehrle actively
practices in the area of trust administration. Once a trust becomes
active (at the death of the Trustee), a number of
complicated events must occur. This includes the transfer of
property, the changing of title of property to the beneficiaries,
and the parceling out of specific gifts.
Often these tasks can
be quite daunting for a family member with no legal training. Bob
takes a great deal of time to assist family members in the
administration of the trust, making the division of assets and the
distribution of property as quick and as simple as possible.
Fees for trust
administration are hourly, but quite reasonable. Additionally, Bob
can provide tax and general legal counsel regarding the best
distribution of assets, as well as the preparation of an estate tax
return which is often required.
